Patents and trademarks exist to help people protect their ideas and their inventions. But sometimes, the legal issues surrounding patents and trademarks can be murky at best. When is an idea original? When can a ruling be contested? In 2010, Brian Kurzmann took on a case that revolved around these intriguing questions. His client had been denied trademark protection for the name of a website, but felt as though the ruling was made in error. Brian appealed the ruling to the United States Patent and Trademark Office, arguing within the doctrines of trademark law that the client’s website name should have been granted protection. Brian was eventually handed a victory. Although Brian’s law practice does not focus on work before the Patent and Trademark Office (in fact, as a transactional attorney, Brian’s focus is on keeping clients out of disputes), this can be regarded as an affirmation by a governmental body of Brian’s meticulous, yet business-savvy style of work.
